Jakarta – Chairperson of the General Election Commission (KPU) Arief Budiman said that he handed over to the judges of the Constitutional Court (MK) for Prabowo-Sandi’s demands that all KPU commissioners be fired. Arief invited the Constitutional Court to judge and decide on the claim.
“What is the Court’s decision or not . Yes, later, please, the court will judge,” Arief said at the Constitutional Court Building, Jalan Imam Bonjol, Menteng, Jakarta, Wednesday (06/12/2019).
Arief only reminded that all issues related to the process and election organizers have room to complain or sue them as stipulated in legislation, especially Law Number 7 of 2017 concerning Elections.
According to him, if there were allegations of violations of electoral administration or process disputes, it could be reported to Bawaslu. Likewise, election crimes can be reported to Gakkumdu Center and election outcome disputes can be sued to the Constitutional Court.
“If there is a violation of ethics, the performance of the commissioner, please take it to DKPP. That (KPU performance) is the room in DKPP,” he said.
Even so, Arief was reluctant to mention Prabowo-Sandi’s demands to the Constitutional Court about the dismissal of all KPU commissioners who had the wrong address. The KPU, he said, surrendered entirely to the judgment of the Constitutional Court judge.
“This (the demand for the dismissal of all KPU commissioners) is incorrectly addressed or not, yes please the Court that evaluates,” he concluded.
As is known, one of the 15 petitum points contained in the improvement of the dispute over the election results dispute (PHPU) of the Presidential Election submitted by Prabowo-Sabdi to the Constitutional Court stated, “Ordering state institutions authorized to dismiss all commissioners and conduct new recruitment to fill positions KPU commissioner. ”
