Bandung – The public prosecutor (JPU) asked the panel of judges to impose a sentence of six years in prison and a fine of Rp 50 million subsidiary three months imprisonment to Habib Assayid Bahar bin Smith aka Bahar bin Ali bin Smith, accused of child abuse Bandung District Court in Bandung City Archives and Library Building, Thursday (06/13/2019).
“The defendant was found guilty of committing a criminal act jointly against the law seizing someone’s freedom, openly and jointly committing violence against people, placing, letting, doing, telling them to commit violence against children to cause serious injuries,” said prosecutor Purwanto Joko.
Previously, the prosecutor charged Bahar with seven layered articles. But in the trial with the agenda of reading the demands, the prosecutor presented facts, evidence, and instructions and found the defendant’s actions violated the first primary charge of Article 333 paragraph (2) of the Criminal Code (Book of Criminal Law) juncto Article 55 paragraph (1) to 1 The Criminal Code, the second primary indictment of Article 170 paragraph (2) to 2, and the third charge of Article 80 paragraph (2) in conjunction with article 76C of the Child Protection Act.
Before filing a claim, the prosecutor considers matters that can be burdensome and lightening for the defendant. Purwanto said the incriminating things were that the defendant had been convicted of sweeping in 2012, the defendant’s actions resulted in serious injuries, and his actions were disturbing the public.
“While things were alleviating, the defendant acted politely in the trial, confessed to his actions, regretted his actions, and there was peace between the defendant and the victim,” Purwanto Joko said.
